Decision re: 53 Towpath Lane needs to be approved – In October, the ZBA denied a use variance to locate a shed in the side yard of a home owned by Julie Severance in Riverbend VI. Town Zoning Code allows sheds only in the rear yard for homes in this section of Riverbend. Hence, the request for a use variance.
Review of Riverbend Zoning Requirements re: sheds, fences, pools, and other accessory structures (gazebos, pergolas, etc.).
Development of a mini booklet requested by Acting Chairman Benoit which would condense all ZBA matters from the Town Code into a small, easy to use paper document.
Interpretations - The Planning Board has had several requests for interpretations regarding sections of Town Code and would like the ZBA to issue an interpretation. A. Roadside Frontage – A minimum amount of roadside frontage is required for each lot. All frontage that abuts a public street is counted towards meeting the requirement. For some parcels, the frontage could occur on two or more public streets. A developer, has asked if the frontage can also include property along a private road? B. “Large” House Additions - The Planning Board had two cases in 2022 where a homeowner built an addition greater than 25% of the existing house. If a new single-family house was to be built on the site, it would be exempt from site plan review regardless of its size per § 161-84 A. (2). But, it appears that subpart (4) would require site plan review if a house addition of greater than 25% of the size of the existing house was to occur. The ZBA needs to determine if (4) is meant to apply to one & two-family homes as well as other types of structures (commercial and industrial)
